Abstrakti

Analyses the rules of Directive 2014/24 art.73 on the termination of a public contract due to its "substantial" modification which would have required a new procurement procedure pursuant to art.72, including a comparison of how art.73 has been implemented in the UK and the Scandinavian states. Identifies specific issues regarding art.73 that have been left to the discretion of Member States and comments on the scope for uncertainty this creates.
