This article explores the legal history of the Finnish-Swedish Transboundary River Agreements in the Torne River basin. It examines the historical background and the legal-administrative frameworks established by the 1971 and 2010 Agreements. The 1971 Agreement represented a pioneering model of transboundary water management, creating a joint Finnish-Swedish Transboundary River Commission with extensive legal competencies and a strong cross-border mandate. However, by the 1990s, this arrangement began to face both practical and legal challenges, including issues related to constitutional law, human rights, European Union law, and evolving international legal obligations. This ultimately led to the 2010 Agreement, which reintroduced national laws and administrative procedures as the primary regulatory framework – significantly transforming the earlier model of integrated governance. The article analyses the reasons behind this shift, including changes in legal thinking, administrative needs, and broader societal developments. It also considers the wider implications for Arctic governance and reflects on the potential value of re-establishing more integrated transboundary arrangements in the future. The study concludes that while the 2010 Agreement succeeded in addressing specific legal and administrative concerns, it also marks a step back from the innovative, cooperative spirit of the 1971 framework. This highlights the ongoing tension between national sovereignty and the demands of effective transboundary environmental governance.
