This lecture explores the future of international law of the sea about a rising China by examining its negotiation history.
The first part focuses on China's participation in the United Nations Convention on the Law of the Sea (UNCLOS) negotiations, drawing from archival records of the Third UN Conference on the Law of the Sea (1973-1982).
The second part analyzes the period from UNCLOS's adoption in 1982 to the beginning of the Biodiversity Beyond National Jurisdiction (BBNJ) process in 2004, highlighting China's changing practices concerning deep seabed mineral resources and its concerns about UNCLOS and the 1995 Fish Stocks Agreement.
Finally, the lecture reviews China's involvement in BBNJ negotiations from 2004 to 2023, examining the evolution of its positions and motivations and concluding with insights into the implications of China's engagement with international maritime law moving forward.
