The case of Vuotos: Interplay between international, community and national environmental law

Abstract

The Vuotos Case concerns the proposed construction of a reservoir and dam on the upper course of the Kemijoki River in Finland in 1992. Swedish officials and civil society were concerned about the possible effects of the construction of the reservoir on the Gulf of Bothnia. The first goal of this article is to examine how the different legal procedures concerned with the Vuotos project proceeded in time and how they interacted. The second goal is to examine, in depth, the two main legal procedures influencing the outcome of the case - Sweden's participation in the Finnish licensing procedure and, more importantly, the licensing procedure itself.
